      M. Dean Sutton is licensed to practice law in all state courts in every county in California and Colorado, and also in U.S. federal courts in the Northern District and Eastern District of California, the Ninth Circuit, and the U.S. Supreme Court.  Other attorneys with various areas of experience and emphasis are available to provide legal services as needed by specific arrangement.

    We emphasize litigation in Santa Clara County, San Mateo County, Santa Cruz County, Monterey County, and San Benito County.   In appropriate cases, we can refer a client to a lawyer in another jurisdiction, or associate local counsel to handle important litigation.

REAL PROPERTY CONSULTATION AND TRANSACTIONS
    We offer consultation and legal advice to buyers, sellers, renters, landlords, lenders, borrowers, and others involved in real estate transactions.  We can offer general advice, review and comment on transaction documents, prepare standard form or custom transaction documents, and/or negotiate with other parties on behalf of our clients.

 

CIVIL LITIGATION
    We represent clients in many types of civil actions (lawsuits), including real property disputes, including: unlawful detainer (eviction), residential landlord-tenant problems, commercial leases, construction, mechanic's lien, judicial foreclosure, nonjudicial "power of sale" foreclosure, quiet title, easement, partition of co-ownerships (such as joint tenancy, tenancy in common, and tenancy in partnership), boundary lines, trespass, nuisance, palimony claims under the Lee Marvin case, mortgages, and ownership disagreements.

    We also handle litigation concerning business law, business accounting and dissolution (such as actions involving trustees, partners, LLC (limited liability company) members, and corporate shareholders, civil rights, and First Amendment issues.

 

 ALTERNATIVE DISPUTE RESOLUTION - ADR - MEDIATION AND ARBITRATION
    We represent clients in mediation and negotiating sessions, in nonbinding arbitrations, and in binding contractual arbitration.
 
 
OTHER CONTRACTS AND CONSULTATION
    Clients frequently seek legal advice concerning other types of contracts.  These include: consumer protection laws, purchase and sale of automobiles and other vehicles, sales of "goods" (such as business equipment) governed by Article 2 under the Uniform Commercial Code, and others.  We advise and assist with business formation and operation, including partnerships, corporations, limited liability companies, and sole proprietorships.  We also advise and assist with property agreements between married and unmarried couples.

 

PROBATE AND TRUST ESTATE ADMINISTRATION

        We represent clients in administering estates after death, including formal probate court proceedings, and "living trust"   administration.        

 

TORT AND OTHER MATTERS
       We represent clients in non-contract "tort" matters, including claims of landowner liability, negligence, fraud, and other tortious conduct.   We represent clients concerning claims before the Labor Commissioner for wages, overtime, other legal benefits.
